Preventing removal of client from UK

Monday 13 February 2012

I am an immigration solicitor. I have just been notified that my client is about to be removed from the United Kingdom tonight. Under the judicial review process, how do I prevent his removal as a matter of urgency?

If your client's case is exceptionally urgent and the application needs to be determined within a certain time scale, you should submit the following to the administrative court:

  • a judicial review form N461;
  • a judicial review application for urgent consideration on form N463;
  • a draft order seeking injunctive relief;

You should serve the documents on the United Kingdom Border Agency, Treasury solicitors and other interested parties.

More information is available in the Law Society practice notes on Immigration Judicial Review.
