Rise in fee for swearing oath
Is it true that the fee for swearing oaths has risen to £10?
Under The Commissioners for Oaths (Fees) Order 1993 SI 1993/2297, the swear fees for solicitors remain at £5 per deponent and £2 for exhibits. A fee of £6 for the oath and £2 for exhibits came in in April 2011 for the probate registries only, to be collected by court officials: we are of the view it is not applicable to solicitors’ practices. The order under which this was done is The Non-Contentious Probate Fees (Amendment) Order 2011 (SI 2011/588).
Under The Magistrates Courts Fees Order 2008 SI 2008/21052 and The Civil Proceedings Fees Order 2008 SI 2008/1053, the courts (other than the County court) now charge between £10 and £25 for a swear fee whereas it used to be a free service.
The Law Society is currently negotiating with the Ministry of Justice to increase swear fees.
