When I drafted deeds to remove these (add word of your choice) as trustees from the pointless trust they had set up for my client, they demanded an admin fee of £100. This is on top of the £4,000 they charged for the worthless family trust and Wills in the first place.

What benefits arise from these family protection trusts - very little in my estimation, apart from the fees paid to the solicitors/promotors of the trust schemes - especially if they get themselves appointed as trustees. A friend of mine was nearly inveigled into putting her house into such a trust, until she had the sense to run the draft documentation past me. The documents were a drafting disaster and, if completed, would have effectively deprived her of the very house she lived in as assigned to a discretionary trust under the control of a relative, who would have been able to evict her on six weeks notice. I wouldn't touch such schemes with a barge-pole!

The SRA can still take action to prevent the former solicitors having their names restored the roll or from working is any regulated firm. The question is will the SRA do anything, or is this another "too big to do anything" firm?
