Does the Government itself set a healthy precedent for utilising out of court negotiation ?

Absolutely NOT !

Very, very, very few of the Government / public authorities featuring in my experience of litigation over the past 20 years, have ever suggested ADR or mediation themselves, even in the strongest of Claimant cases. I recall 3 mediations in 20 years, all ordered by the Court itself.
On paper, the Government (and the taxpayer) have everything to gain by negotiation-in practice, nine out of ten absolutely can`t be bothered and would prefer to negotiate a week before trial or turn up at the door of the Court with proposals.

After all, it`s not their money they`re spending !

If you had not witnessed this ponderous farce of "no no no no no no no no no no no no no no-Yes!" for yourself, you would be quite unable to credit it.
