This is the most complex case the judge has ever dealt with. The husband was recalcitrant to the point of being willing to go to prison. The judge's award has been very substantial. So on what basis does the judge say that the huge amount of work the solicitors put into the pre-trial work was excessive. He says:‘It cannot be right that all the litigation funding is spent long before the final hearing, which is, on any view, the most important part of the entire litigation exercise." Well that may be so for judges and counsel but we all know cases which are won or lost on pre-trial work, or are settled or mediated based on what has been found out in pre-trial work. I think the judge's comments are out of order.
