What this decision may produce is firms who know they will be late if they do their costs budget properly putting in seriously inflated figures. Firms acting for clients with limited budgets may take this course anyway. That will result in a lengthy argument at the hearing and no doubt an imposed reduction but no penalty.

If doing it properly means you have to have the help of costs lawyers (as suggested above) how does that actually reduce costs. Woudn't a more effective system of assessing costs after the event have been the better course - oh! I forgot, all these changes are about making the judges' jobs easier, aren't they - silly me.
