Litigation, the indemnity principle, uncertainty in case development etc - these are the challenges of implementing something that provides a differentiator. Of course it seems hard or even impossible to many of us - as someone said above, if it was easy - we'd all be doing it! The devil of this will be in the detail and none of us know how QS will implement it but others have in complex litigation so it's not impossible. If they achieve it, it's much more powerful than just offering fixed fees for those areas it is easiest as the poster above suggests - that's just doing what everyone else does and so provides no competitive advantage. If they can truly say in their marketing - "unlike most, we'll always agree a fee with you in advance for any legal work" - that will win them clients, no question. As for Mr Sayer - conveyancing can be varied but no serious provider charges other than a fixed fee for it now; doesn't that undermine your point?! I think this is the inevitable direction of the market and, frustratingly, QS will get the credit from the public if they steal a march on the rest of us.
