I think Mr Spencer is confusing two separate issues. Third party capture relates to insurers dealing direct with injured parties and only sometimes involves settling claims without the requirement of medical evidence. Pre medical settlements offers are regularly made to (and more often than not directly requested by) Claimant's solicitors.
If the industry wants rid of pre-medical offers then maybe those on the Claimant side should stop asking for them!
