I do agree with Elaine Hughes. The system was not broken pre- Woolf by any means and I believe some of the Woolf Reforms have worked well. Although I've had to question my own understanding of the word "proportionality" when it came to costs... and for the record there was nothing at all wrong with the Scale 1 and Scale 2 costs system and the whole costs industry that sprung up around costs post -Woolf is nothing short of a disgrace. Due to the Mitchell decision we all now live in abject fear of making any human error or of finding that some data input error has put us in breach. And because we all have to do more for less, there but for the grace of God go I.
