We all know that there are aspects of Islamic Religious Law that is within the prevailing English Law provisions. We also know that there are, presumably, considerable requirements that vastly exceed the restraints applied by English Law upon the "freedom" to comply with Islamic Religious law.
As there will be a majority of Islamic Wills which are going to prove unenforceable by the English Courts, presumably we can anticipate that the present Islamic "Courts" around the Country hearing Islamic marital breakdown claims will "acquire" forms of Chancery jurisdiction?
What I would like to know is why we are permitting our professional body to allow fellow practitioners to purport to exhibit professional capacity to undertake work in foreign jurisprudence at our professional liability? And what is our Government doing by permitting a parallel, and sinister, legal system to develope to the detriment and detraction to and from our nationwide, secular law?
