The issue with whiplash claims is that they are non-demonstrable injuries. There is simply no way of proving without a shadow of a doubt that someone has injuryed themselves. I have had accidents where I have in all honesty suffered from neck pains for a few weeks.....other people may have suffered worse symptoms due to their physical make up, applying the egg shell skull principle loosely. Also, a low speed impact is in itself not evidence of a fraudulent claim, you have to look at the make and models and weights of the vehicles, the gradient of any slope, the position of the parties in their vehicle etc.

There are also a significant amount of fraudulent claims submnitted every day, normally following a chat with a "man down the pub".

There has to be a way of identifying these fraudulent claims and ensuring that those whom are genuinely injured receive the compensation that they deserve.

It is interesting that cars have been in existence for quite some time not and it is only in recent times that whiplash claims have become the norm. For me, there is a whiplash culture in this country and without the intervention of lawyers in those claims, fraudulent claims could simply increase.
