Yes the vast majority are David, many settle before any court proceedings are started and when proceedings are started the parties, when they are ready, in the majority of cases reach a settlement be it by way of a round table meeting or other ADR means. Jackson and the Mitchell decision has upset the balance of co-operation that grown up since the CPR reforms causing lead lawyers to act in a defense manner and therfore I suspect Rod's comments are about trying to get back to a situation in which the majority of cases are settled with the the court's over bearing input.
