All very interesting but even here, with news of a more relaxed approach, we find that the tendency to look at form rather than content dogs the system. One is tempted to call it an increasingly obsessive tendency.

According to this article, at two points in Summit Asset Management Ltd v Andrew Clive Coates the court had to deal with errors as to form. The initial 'unless' order related to the incorrect form of the defence. During the application for relief the court felt it necessary to consider the failure of the defendant to use the correct form when seeking a time extension. The fact that the latter had even to be mentioned suggests that, on other occasions in other cases the fact that an application is not in the prescribed form will militate against the applicant.

Not quite 'Forms of Case' yet but getting nearer by the week.
