Judge Sir James Munby is evidently forward thinking in his views. Whilst it is claimed that mediation 'doesn't work', what can certainly make it more attractive, and approachable - where children in separating families are concerned - would be to adopt a facilitative approach to mediation, especially in disputes over post separation parenting time; underpinned by a 'time-based' framework setting out the norms of post separation parenting in the median case. Why litigate when you know what a Court will most likely endorse?

Such an approach would benefit parents and children alike, from which social benefits will flow.
