Undersettling PI claims will be more of an issue with the reduced fees for Claimant's Solicitors. I recall one case where a PI factory firm had recommended settling at circa £1,500 on an RTA shunt. The Client was very unhappy and swapped Solicitors. We took over the case and with decent Medical evidence recovered something over £50,000. In those circumstances as the negligent advice was not accepted by the Client, he suffered no loss. . but it is hard to know just how often Claimants do undersettle on the advice of their Lawyer. . That case was just pre Portal. How one would get the funding to cover obtaining proper Medical Reports now. . I don't know. . so how one can form a proper view as to quantum in all but the simplest cases is not immediately apparent. .
