It seems that the minority who endorse Jackson and the guillotine effect being applied to all time Orders, without exception, continue to fail to accept that it is wrong to condemn the litigant for the shortcoming of their professional representative.
There is nothing wrong with an "Unless" Order and a stonking costs penalty unless there is demonstrable, irreparable prejudice by the failure to comply when an otherwise blameless litigant is denied their remedy because of the actions of others.
There is nothing clever about stupidity and the repetition of it begs a simple question - why?
