Anon 5:20, I disagree. On the facts of the case as I understand them, the default couldn't have been characterised as trivial by any means. The problem is that the test imposed by the CA was too harsh, and subsequent litigants have been doing their best to chip breathing room out of the hard rock. The result is a pockmarked landscape of cases, which are incredibly difficult to navigate.
