How does one now reconcile Durrant at [48] with this judgment at [79]? Which 'other breaches' are we entitled to look at? Non-trivial breaches arising on the same default? Other previous trivial breaches? Other previous non-trivial breaches? Once again, the Court of Appeal decides to give judgment on the facts without properly explaining the rules it is applying! It's absurd!
