Maybe three mediocre judges would have been more in touch with the realities of litigation - or would have been prepared to admit that they made a real mess of it first time round.

What is truly astonishing is that, even in a judgment of this importance, the three Lords Justices could not speak with unity on what the Rules are actually supposed to mean.

Anyway, the good news is that the idiocy of Mitchell (for that is what it was, whether the CA cares to admit it or not) is consigned to history, Normal(ish) service has been resumed and not every minor(ish) infringement is going to have mortal consequences.
