Just on this issue of costs budgets which was what triggered Mitchell – we have now been put into the position whereby we are negotiating the details of costs budgets for work which has never been done and never may be done in cases which will almost inevitably settle and not go to trial (over 90% of personal injury cases settle of course – or are withdrawn). How long will it take to update witness statements? How long will it take to prepare the trial bundle, etc etc in these multi track personal injury cases which will probably settle. We have moved that is into a future world of presumption where we are arguing over possibilities which will probably not occur, all this incurring costs apparently in the interest of reducing costs. Well done on that one powers that be! Of course the authors of these ideas all have brains larger than planets so I am probably missing something extra-terrestrial here.
