Could claims not be reduced by ensuing their members are not negligent?

The whole point of damages is to put the victim back in the position he (or she) would have been in had the negligence not occurred. You cannot cap that.

I would go so far as to say that 70% of my clients would not be my clients if they had just received an apology in the first place rather that a "high and mighty doctor" brushing them off.

And then there is (forgive me for not knowing the figures) the billion or so written of because of failed IT attempt within the NHS.

Im going to leave it there as i could rant all afternoon...
