I wonder if Dr Tomkins would sing from the same songsheet if she was left severely damaged by the negligence of a surgeon. Far from reducing future loss we ought to be addressing the anomaly of people still trying to survive on the money they were awarded 20 years ago, money subsequently eaten away by inflation.

In the early 80s losing the sight of an eye was worth about £9,000. Many people who lost an eye then are still coping with the loss today, when £9,000 doesn't even cover the cost of the average wedding.
