David's comment early in the list and made across lunchtime on 25 July, in which he writes of the 'good old days', is spot on. I too am old enough to remember when generally speaking, legislation was only used to right some wrong. A successful exception was the tide of progressive reforms proposed by Lord Woolf. But sadly civil lit and PI have been regarded as wide open to endless tinkering ever since.
Too many of the reforms in recent years have been driven by the insurance lobby. We need government to have a clear perception of right and wrong, stop tinkering i.e. 'if it ain't broke (etc)'and do not get lured into serving the agenda of any particular group.
The classic example of recent and fruitless change in the era of tinkering, is the ban on referral fees. With one hand introduce a ban, with the other hand allow the management companies that charge referral fees, to continue business albeit morphed via new provisions that allow them to continue nay prosper, as Alternative Business Structures.
