Some neighbours can be mediated, but I doubt this one could have been, not least because it involved a claim by householders against a business and incuded a claim for an injunction. That helps to explain why the case was so hard-fought.

The speeches in the Supreme Court do not indicate that the defendant made any offer which should have been accepted. Defendants in these noise nuisance cases are typically businesses, which have no intention of admitting the nuisance or offering undertakings. If local authorities did their jobs properly and terminated noise nuisances rapidly and effectively, householders would not have to bring these claims in the first place.
