My experience (limited to the fields of financial services and pensions) is that much less than 25% of claimants with good claims for significant losses actually make a claim. Nearer 10% in my view.

The dramatic fall in litigation over the last 25 years is documented by Dame Hazel Genn in her FA Mann memorial lecture on the UCL website. Worth a read, albeit pre LASPO, and therefore a bit out of date. Things will be even worse now.
