The Practice Direction should I think be questioned as the previous sentence to the one quoted makes it clear that the Judges make a distinction between barristers and solicitor advocates. They use the word counsel in relation to junior barristers only which is clearly wrong under the current statutory regime. One cannot function as a higher courts advocate without recognition of one's rights as counsel. Given that there are no distinctions dress ought to be standardised. The QC distinction remains but this is of course an open competition for all higher courts advocates. We should do away with "junior" to I think.
