I have worked in various High Street firms for many years specialising in Claimant Clinical Negligence. Almost all of my clients come to me because they have tried all other avenues and all have failed them. They cannot get a straight answer from the hospital, their MP cannot or will not help, and the various medical professional bodies are too busy protecting their members. What are the two most popular comments? "Its not about the money" and "I just want to know what happened" Introduce a legally enforceable duty of candour to all NHS organisations, give all NHS Trusts the power to admit fault and pay modest compensation, and introduce a proper complaints system. Then we can talk about restricting compensation. If I buy a kettle from ASDA or clothes from M&S and they are wrong - I don't get arguments about its not their fault or its my fault for buying from them in the first place. They simply change in and we all move on. The NHS is not a national religion. It is not beyond criticism. This really is not rocket science!
