That would be three months actual work by the lawyers, to which must be added the not lease than nine months of delays introduced by the Court.
Ifit is taking 9 months to get a CMC then the three months idea is a pipe dream.
At the other end of the scale I issued a small claim matter for a client in June in the CCMCC. A defence was filed and following completion of Small Claims Qs the papers transferred to a local Court in August. Standard Directions were issued leading to a trial date in February. If the Court System can not cope with a Small Claim matter in three months how can it hope to deal with a multi track case in that time scale?
In the Fast Track System I have a file on my desk where I issued the Claim in May, and we are having a telephone directions appointment later this month.
I had a trial date for 1st October vacated by the Court in late September. No sign of a new hearing date.
Multi Track? Issued last year, and look forward to a hearing nest spring.
I have almost given up seeking summary judgment, because of the time it takes to get a listing for even a relatively short hearing,
I recently successfully defended a summary Judgment application that had been listed for hearing two weeks before the trial. Of course the trial date was then vacated, and the matter went off into the distant future.
I do not blame the Court Staff, or the Judiciary, who struggle with the load, but the Orwellian named Ministry of Justice, who have hollowed out locating staffing levels to a point where it is surprising that anything works at all.
