How Wills can be regulated for a profession but unregulated for those not in that profession is an absurdity. Just look at the catastrophes of ITC/Chorus Law and Express Law (as was) and the extortionate fees they charge(d) which were usually three or four times the going rate for a qualified regulated and insured solicitor.

If all the unregulated sector becomes regulated then they will need to be insured so think about the effect on PII premiums when the claims begin working their way through the system. I am waiting for the same thing to happen when legal executives begin practising independently.

It seems that the best thing to do is to transfer to the Bar or the CLC and establish oneself as a sole practitioner doing the same private client work with direct access to the public but with the benefit of the lower cost of regulation and a mutual indemnity fund.
