I enjoyed reading Rachel's opinion and bringing this issue up for debate. I would add that it is incumbent on confident and expert litigators to push boundaries in litigation and ask courts to make 'concurrent evidence' orders, setting out the compelling reasons as to how the litigation will benefit. From this maybe the judiciary will be more confident to explore issues pre trial and make such orders commonplace.
