I have attended a great many mediations, acting for Defendants. With one honourable exception, whenever Counsel appears (for the Claimant) the process becomes bogged down with minutiae, Counsel very often egging on their client and posturing unnecessarily I assume Counsel is instructed because the Claimant's Solicitor fears a negligence claim/complaint if the mediation doesn't go well. When it comes to costs I refuse to pay for two lots of legal advisers. I would go so far as to say I prefer the mediator not to be Counsel either (and boy could I name some names....)
