It would not be in anyone's interest (except the lawyers) to set out a definitive proportionality rule. Proportionality should remain in the realm of 'know it when I see it' to enable judges to come to reasonable conclusions and not provide a shield for lawyers who point to a set rule to justify unreasonable costs. Uncertainty for lawyers is exactly what we need- a subtle pervading pressure to keep costs down and limit padding.
