Comment

There is something truly repellent about having to buy one's way into court. Many litigants will, presumably, not have a spare 5 or 10 thousand lying around and will therefore look to their lawyers to pay. No analogy can be drawn with arbitrators charging fees since (a) in that arena the overwhelming majority of cases are commercial and (b) the parties agree beforehand to arbitrate.
