why not have kept the issue fees the same with the court instead taking a 'trial fee' calculated on the basis of i a % of the budget approved legal costs of cases worth over 10,000. whoever loses the case pays that trial fee based on whatever budget they put in. claimants could get ATE to cover the risk and overall by doing it this way it would not been such a barrier to access justice ( the courts) in the first place. plus huge extra incentive to settle cases/reduce judges time etc etc
