Possibly you should read my comment properly.

The point is not that law is not a business, but that it is a business with liabilities and responsibilities unlike other businesses.

The clients interests are paramount as a matter of professional liability. No other business has such a responsibility.

Strangely enough, I don't actually complain about that responsibility, it has to be the case in any meaningful legal system.

However, the idea that one can have both that and an entirely free market is nonsense. And that is what has been attempted, with marketing having been held up as the snake oil which can square this circle. It can't.

You can't buy a Jag at a second hand Mini price. The Law Society encouraging the public to believe one can has been disastrous.

Even the High Court confirmed that prohibiting the payment of referral fees would have been in the public interest in respect of professions. Naturally, the Law Society didn't even try to bring a similar case.

And further, Parliament having unleashed the spiv genie, have tied to put it back in the bottle with regard to PI. Too late.

But fine, if people want a spiv society, they've got one.
