Don’t for one moment rely on a Labour government stopping this, don’t expect anyone else to solve this , it won’t happen, that’s how we have got where we are now . For once the profession should unite to stop this . Between the end of the current contracts in July 2015 and the start of the new contracts the LAA is going to be reliant on the ‘goodwill’ of current crime firms to voluntarily extend contracts . The Bar stood up the MOJ and won by refusing return work. What if forms didn't agree to extend contracts ? they couldn't be in breach. August is a time for holidays – if all crime firms decided to close their departments for a couple of weeks at the beginning of August where would the MOJ be ? Of course such a move could never be openly encouraged – and there would be a risk of costs orders being made, or defendants being sentenced without representation , but on the other hand, consider how much of that happened when the Bar was refusing work , even when Judges were put under clear pressure to keep the courts running – but magistrates couldn't be pressurized without pensions to worry about . Of course such actions could never be encouraged or condoned – but it’s a thought ….
