I am astounded that the current Master of the Rolls advocates the adoption of Article 191 of the Brazilian Civil Code which ‘allows the parties to modify the procedure as it applies to their claim’. This was the system we had in place pre Woolf in 1999 which imposed Court interference 'to case manage' thereby increasing judicial costs and then withdrew funding from the Civil Justice budget
