Comment

The Woolf rreport was full of fine words and good intentions. Its flaw as that it sought to increase judical control over the litigation process and at the same time reduce costs. It was not understood by that more flexibility, and more judicial case management, meant more work, and thence more cost. The objectives were irreconcilable. This was not understood because the reforms were "top down" and were driven by those with little or no expereince at the coal face.
