Legal Advisers are Solicitors or Barristers and the majority trained to undertake this work will already have held semi-judicial powers under the Criminal Procedure Rules or the Family Procedure Rules. A large number are qualified to apply for Deputy and District Judge positions - some choose to, others do not. The nature of their current work requires an excellent understanding of criminal and/or family procedure and criminal sentencing. The majority have more understanding than your average defence solicitor and in my experience often have to correct advocates who make mistakes or just haven't a clue. In some areas Legal Advisers are already undertaking uncontested divorce cases. What difference is there extending powers to civil proceedings? None at all. They are trained to have an attention for detail, which makes them ideal candidates for this type of work. The legal adviser has long been a poor relation and looked down upon in public service. It is about time they received the credit they deserve. Go ahead and appeal their decisions - this will be welcomed. Private practitioners will soon learn that few mistakes will be made.
