Martin, while I am inclined to agree that divorce need not necessarily involve a court, I cannot see what is so "absurd" about people in love being able to marry regardless of their gender. That is surely an enhancement of marriage rather than a debasement

And I actually think this proposal is eminently sensible. Dealing with an application to extend time for service, for example, surely does not require the knowledge and experience of a judge. If court time and money is saved by training solicitors or barristers to deal with such applications then why not?

Plus, commenters on this site often complain that issues are being decided by judges who are "out of touch" with the realities of handling a piece of litigation. Perhaps having procedural decisions made by experienced lawyers, who have conducted litigation themselves, would be a genuine improvement to the system?
