Anon 28 April 2015 02:19 - there's nothing wrong with a credibility ambush, if you live in a world where that hurts the Claimant more than the solicitors representing them. After all - how often do you think a dodgy Claimant picks up the tab? It's always the Claimant solicitors, their insurers or the Defendants who get screwed.

If there is evidence that shows my client is lying to me, I won't waste the money issuing the claim. To-date we have had no way of actually seeing that our clients are misleading us about their accident history other than GP records - which are spotty at best. It can only be a good thing that we may get the opportunity to weed a few out early. It benefits the insurers too because they will not have to spend any time considering the case and Defending it if we never bring it.

Richard - With regards to failures to search, the intention appears to be that when the search becomes mandatory in June an askCue reference will have to be included with the CNF much like the new MedCo references.
