Does anyone know how this will impact on defence solicitors claiming their costs back? For example, if the defence can claim back the fees already paid before the decision was reversed.

I appreciate that the claimant's solicitors pay the fee but with the defence ultimately paying when they pay the claimant's costs of the case, can they recover anything paid prior to the U-turn?
