I think you have rather missed the point.
One of the purposes of the Crown (state) is, and must be, to deliver a system of justice between its citizens.
Whilst there must be a fee for doing so, to discourage trivial disputes, that cannot be so high as to render the delivery of justice unattainable for the majority of subjects (citizens).
If that is the case, the Crown (state) will cease to have any authority whatsoever. The consequences of that will, ultimately, be the collapse of civil order.
