Nevermind the lawyer bashing. How about the whole issue of access to justice? Very few Claimant firms are going to be able to afford to continue to run clinical negligence claims, if the fixed fees are set at a similar level to those in Personal Injury. A threshold of £250,000 is going to include a large number of Claimants who have suffered very serious injuries. Contrary to what certain sectors would like us all to think, Claimants are not all pursuing their claims out of pure greed - medical injuries may prevent a Claimant from being able to work, or lead to them needing paid care and assistance, in order to carry out basic daily activities, which many of us take for granted. How are they going to get proper legal representation if they suffer any injury as a result of clinical negligence? This government does not care and is taking advantage of the fact that public opinion at the moment has little sympathy with (a) professionals (e.g. the recent medical consultant bashing) and (b) people who pursue compensation claims generally. This is distracting everyone from the real issue of access to justice, which is what we should be fighting for and surely what we should expect in a civilised 21st century society.
