The airwaves and newspapers are awash with firms now suddenly professing to be Clin Neg specialists. If the Courts are not aware, it is because Claimants & their cost clerks are failing in their duty to correctly ascribe relevant experience. I am curious how Courts "see" how Defendants handle the cases, when Defendants do not lodge their files for a Claimant assessment, but nevertheless, the outcome remains dependant on the quality of whom represents the paying party.

Your comments about running cases to assessment and incurring costs, perhaps best highlights the fault in the system, which will I'm sure be cured fully with the removal of the need for such satellite litigation by properly bringing costs within the fixed recoverable scheme now suggested
