Good post at 10.07. The insurers promise of a landscape of falling premiums has proved false. We all knew it would end that way. I don't for one minute think that the government believed them either. It was simply as excuse for them to try and stamp on behaviour they didn't like. Insurers simply are unable to change their spots and adapt their model. They should embrace the opportunites LASPO has given them by keeping claims in the portal & making sensible offers to settle. It is also much cheaper for insurers to defend claims which they think are bogus. Instead what practitioners on the claimant side are faced with is insurers dropping claims because they are too slow to investigate. They continue to make hopeless settlement offers resulting in unnecessary stage 3 hearings and raise causation arguments on nearly every claim resulting in further litigation. They now moan bitterly because claimant's have adapted quicker and behave better.
