Are we in danger of losing sight of the fact that the victim is being expected to pay a large portion of their award toward their own costs simply because this government and others, insurers etc want to reduce their liability and it seems the only way they can is by punishing the victim.
Is it not also the case that most fee's mount up because of the defendants refusal to accept liability and even when they do they'll argue causation. In fact they themselves are forcing costs to rise to levels which often exceed the compensation offered.
