Perhaps we would do well to expand the adjudication scheme currently used for construction cases to all matters that seek a monetary award, regardless of value. First tier documents alone. No court room, no witnesses being crossed, anonymity for the parties, and judges sitting at home in their underpants drinking tea and eating biscuits while they consider the facts. Or, in matters where the parties are both corporate entities impose compulsory arbitration, or a variant, so only consumer cases go to court. That should reduce the listings, free up court time, maintain work for lawyers and give those that want it the opportunity to represent themselves using technical staff from inhouse. Just a thought.
