"Reasonable and proportionate fixed legal costs". But proportionat to what? The sum at stake or the means of the parties?

Dyson has never been a solicitor, so he has never had to discuss the cost and risk of a claim with a claimant. It's not the claimant's own legal costs which are the problem; it's the risk of the defendant's costs.

Even fixed costs will be unaffordable to most people, remembering also that the ordinary citizen pays 20% more than the corporate party because of VAT.

The judges can fix this by means based costs capping, but have refused to entertain this.
