Anonymous3 @ November 2015 04:29 pm - what makes you say mediation is alwys the best option? Mediatin is *often* a good option, but it is not appropriate in all cases. In family caes, for instance, where there is a history of domestic abuse, where there is a disparity in the parties knowlege nad confidence around finacial matters, or where either party if not fully committed and not prepared to be open and honest it may not be appropriate.
Presumably in non-family cases, mediation may be inappropriate where the parties are very unequal in their understanding or esources, ir where one party is uncooperative .
I don't think there is a single process which is *always* best
